California School Employee Investigated After Posting Militia Recruitment Videos

Kenisha Daily, a special education staff member employed by the Madera Unified School District at Lincoln Elementary School, posted multiple videos to social media in which she appeared to load a shotgun and a pistol while calling on viewers to form what she described as a Black militia. In one clip she stated intent to rob white people. The school district placed Daily on administrative leave and immediately sought and obtained a temporary restraining order. Madera Unified confirmed it is cooperating fully with the Madera Police Department, which has opened a formal investigation. Officers conducted a home visit with Daily as part of that investigation. The district also announced enhanced security measures at Lincoln Elementary.

Daily's public response characterized the videos as personal firearms training content with no intent to threaten. Whether or not that characterization is legally sufficient, it does not address the most operationally relevant dimension of the case: a school employee with regular access to children used a public social media platform to broadcast content that includes racially framed incitement to commit robbery and to organize an armed group. California's criminal threat statutes require a specific, credible, and immediate threat to a specific person, which can be a difficult threshold to meet for generalized social media content. The temporary restraining order is the most immediately accessible legal remedy and limits Daily's proximity to the school and potentially to school personnel.
